making it a security under<a href=\"https:\/\/coinscreed.com\/staging\/crypto-tokens-to-become-securities-according-to-grayscale.html\" target=\"_blank\" rel=\"noreferrer noopener\"> federal securities laws<\/a>.<\/p>\n\n\n\n<p>&#8220;The court should approve Defendant's Motion and should reject the SEC's Motion,&#8221; Ripple said in the letter.<\/p>\n\n\n\n<p>On December 3, Ripple's general counsel, Stuart Alderoty, tweeted that this was the company's &#8220;last filing&#8221; requesting the judge to &#8220;grant&#8221; judgment in its favor.<\/p>\n\n\n\n<p>He added that Ripple is proud of the defense it has mounted &#8220;on behalf of the entire crypto industry,&#8221; noting that Ripple has &#8220;always played it straight with the court,&#8221; but subtly criticizing the SEC by saying he &#8220;can't say the same for our adversary.&#8221; Ripple has been accused of engaging in <a href=\"https:\/\/coinscreed.com\/staging\/75-of-illegal-forex-transactions-in-south-korea-are-crypto-related.html\" target=\"_blank\" rel=\"noreferrer noopener\">illegal activities related to cryptocurrency<\/a>.<\/p>\n\n\n\n<p>Alderoty continued to criticize the SEC in a subsequent tweet on December 5, referring to it as a &#8220;bouncing regulator&#8221; width:16px; fill:#000000; stroke:#000000; display:inline-block;\" viewBox=\"0 0 24 24\" version=\"1.1\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" xmlns:svg=\"http:\/\/www.w3.org\/2000\/svg\"><use href=\"#wpil-svg-outbound-7-icon-path\"><\/use><\/svg><\/span><\/a> got underway.<\/p>\n\n\n\n<p>James Filan, a former federal prosecutor, said there are only three points remaining to be resolved in the SEC vs. Ripple case in a previous tweet from November 30.<\/p>\n\n\n\n<p>The &#8220;expert reports,&#8221; the Hinman records, and other information that the SEC and Ripple relied on upon their arguments are all covered by the summary judgment motions, expert challenges, and sealing disputes.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/coinscreed.com\/staging\/ripple-finally-gets-hold-of-sec-hinman-document.html\" target=\"_blank\" rel=\"noreferrer noopener\">William Hinman papers <\/a>make reference to his June 2018 address at the Yahoo Finance All Markets Summit, in which he claimed that Ether (ETH) was not a security.<\/p>\n\n\n\n<p>Judge Torres, in Filan's opinion, won't rule on the three major issues &#8220;separately,&#8221;
