Bankman-Fried trusted Kives and his associates to help FTX raise funds and expand its business. <\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><img decoding=\"async\" src=\"https:\/\/coinscreed.com\/staging\/wp-content\/uploads\/2023\/06\/FTX-.jpeg\" alt=\"FTX Sues Ex-Clinton Aide\u2019s Firm for $700M\" class=\"wp-image-52963\" width=\"553\" height=\"369\" srcset=\"https:\/\/coinscreed.com\/staging\/wp-content\/uploads\/2023\/06\/FTX-.jpeg 639w, https:\/\/coinscreed.com\/staging\/wp-content\/uploads\/2023\/06\/FTX--300x200.jpeg 300w\" sizes=\"(max-width: 553px) 100vw, 553px\" \/><\/figure>\n\n\n\n<p>However, the lawsuit alleges that Kives and his associates used shell companies and fake invoices to siphon off <strong>$700 million<\/strong> from FTX through various deals.<\/p>\n\n\n\n<p><em>For example,<\/em> the lawsuit claims that Kives and Baum used SGN Albany Capital and Mount Olympus Capital to receive <strong>$214 million<\/strong> from FTX in order to buy a minority stake in <a href=\"https:\/\/www.forbes.com\/sites\/elvaramirez\/2021\/02\/16\/kendall-jenner-confirms-tequila-launch-818-arrives-with-awards\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Kendall Jenner's 818<span class=\"wpil-link-icon\" title=\"Link goes to external site.\" style=\"margin: 0 0 0 5px;\"><svg width=\"24\" height=\"24\" style=\"height:16px; width:16px; fill:#000000; stroke:#000000; display:inline-block;\" viewBox=\"0 0 24 24\" version=\"1.1\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" xmlns:svg=\"http:\/\/www.w3.org\/2000\/svg\"><use href=\"#wpil-svg-outbound-7-icon-path\"><\/use><\/svg><\/span><\/a> Tequila brand. <\/p>\n\n\n\n<p>According to SEC filings, the tequila company's assets were only worth <strong>$2.94 million<\/strong> at the time.<\/p>\n\n\n\n<p>The lawsuit also claims that Kives and Baum used SGN Albany Capital to receive <strong>$100 million<\/strong> from FTX to invest in Embed, a $1 billion stock platform. <\/p>\n\n\n\n<p>However, according to the lawsuit, Embed's valuation was based on false projections and inflated metrics.<\/p>\n\n\n\n<p>The lawsuit further claims that Kives and Baum used SGN Albany Capital to receive<strong> $50 million<\/strong> from FTX to pay <a href=\"https:\/\/coinscreed.com\/staging\/ftx-sues-genesis-affiliate-for-3-9-billion.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Genesis Global Capital<\/a>. This crypto lending company was insolvent at the time. <\/p>\n\n\n\n<p>The payment was allegedly made without any due diligence or documentation.<\/p>\n\n\n\n<p>According to the lawsuit, Bankman-Fried disregarded the warnings of FTX employees who suspected that Kives and his associates were scamming the company. <\/p>\n\n\n\n<p>Bankman-Fried continued to rely on Kives and his associates to secure rescue financing in the days leading up to FTX's bankruptcy in November 2022.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-ftx-seeks-justice-and-recovery\">FTX seeks justice and recovery<\/h4>\n\n\n\n<p>The lawsuit argues that the transactions between FTX and the defendants were avoidable under bankruptcy or other laws in the US. <\/p>\n\n\n\n<p>The lawsuit requests that the court declare the transactions void or voidable and order the defendants to return FTX's funds. <\/p>\n\n\n\n<p>It also asks the court to award FTX over <strong>$700 million<\/strong> in compensatory damages, over $100 million in punitive damages, pre-and post-judgment interest, attorneys' fees, costs, and other relief.<\/p>\n\n\n\n<p>Furthermore, FTX has filed lawsuits against other parties involved in its pre-bankruptcy deals, such as <a href=\"https:\/\/coinscreed.com\/staging\/ftx-us-purchases-embed-financial-technologies-for-its-stock-offering.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Embed<\/a> and Genesis Global Capital. <\/p>\n\n\n\n<p>FTX reached a settlement with the Metropolitan Museum of Art on Wednesday, in which the museum agreed to refund <strong>$550 million<\/strong> in donations from FTX entities in 2022.<\/p>\n\n\n\n<p>FTX's new management has recovered more than <strong>$7 billion in assets<\/strong> that can be used to repay customers whose funds were frozen when the crypto exchange collapsed. <\/p>\n\n\n\n<p>The exchange is also working on relaunching its operations under a new name and brand.<\/p>\n\n\n\n<p>As reported by <a href=\"https:\/\/www.theblockcrypto.com\/post\/113982\/ftx-lawsuit-k5-global-michael-kives\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">The Block<span class=\"wpil-link-icon\" title=\"Link goes to external site.\" style=\"margin: 0 0 0 5px;\"><svg width=\"24\" height=\"24\" style=\"height:16px; width:16px; fill:#000000; stroke:#000000; display:inline-block;\" viewBox=\"0 0 24 24\" version=\"1.1\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" xmlns:svg=\"http:\/\/www.w3.org\/2000\/svg\"><use href=\"#wpil-svg-outbound-7-icon-path\"><\/use><\/svg><\/span><\/a>, FTX's lawsuit against K5 Global and its associates is one of the largest legal actions in the crypto industry.
