The protocol aims to enhance the privacy and fungibility of Ethereum, which is otherwise a transparent and traceable network.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Coin Center Challenges OFAC\u2019s Claims<\/h3>\n\n\n\n<p>However, Coin Center, a prominent cryptocurrency advocacy organization, has expressed concerns over the OFAC\u2019s indictment. <\/p>\n\n\n\n<p>Coin Center\u2019s research director, Peter Van Valkenburgh, wrote an opinion piece in which he argued that the evidence presented by the OFAC does not conclusively prove any money transmission-related crimes.<\/p>\n\n\n\n<p>Valkenburgh pointed out that Tornado Cash merely offers software for money transmission but does not provide the money itself. <\/p>\n\n\n\n<p>He said that this distinction is important, as it contradicts the <a href=\"https:\/\/www.fincen.gov\/sites\/default\/files\/2019-05\/FinCEN%20Guidance%20CVC%20FINAL%20508.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">guidance of the U.S. Financial Crimes Enforcement Network (FinCEN),<span class=\"wpil-link-icon\" title=\"Link goes to external site.\" style=\"margin: 0 0 0 5px;\"><svg width=\"24\" height=\"24\" style=\"height:16px; width:16px; fill:#000000; stroke:#000000; display:inline-block;\" viewBox=\"0 0 24 24\" version=\"1.1\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" xmlns:svg=\"http:\/\/www.w3.org\/2000\/svg\"><use href=\"#wpil-svg-outbound-7-icon-path\"><\/use><\/svg><\/span><\/a> which is the primary regulator of money transmission activities in the U.S.<\/p>\n\n\n\n<p>FinCEN\u2019s definition under the U.S. Bank Secrecy Act states, <em>\u201can anonymizing software provider is not a money transmitter.\u201d <\/em>FinCEN also clarifies that only program users can be considered money transmitters, depending on the purpose of their transactions. <\/p>\n\n\n\n<p>The program\u2019s developers have a clear stance on this. They state, <em>\u201cA person that uses the software to anonymize their transactions can be a user or a money transmitter, depending on the transaction\u2019s purpose.\u201d<\/em><\/p>\n\n\n\n<p>Therefore, Valkenburgh contends that Tornado Cash\u2019s role is straightforward. By simplifying the process for users to send money via the <a href=\"https:\/\/docs.tornadoeth.cash\/docs\/generals\/tornado-cash-smart-contracts\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">protocol\u2019s smart contracts,<span class=\"wpil-link-icon\" title=\"Link goes to external site.\" style=\"margin: 0 0 0 5px;\"><svg width=\"24\" height=\"24\" style=\"height:16px; width:16px; fill:#000000; stroke:#000000; display:inline-block;\" viewBox=\"0 0 24 24\" version=\"1.1\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" xmlns:svg=\"http:\/\/www.w3.org\/2000\/svg\"><use href=\"#wpil-svg-outbound-7-icon-path\"><\/use><\/svg><\/span><\/a> it does not label the developers as money transmitters. <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cProviding tools for others to transmit their money doesn\u2019t make them transmitters.\u201d<\/p>\n<cite>Peter Van Valkenburgh<\/cite><\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">Smart Contract Control Is Not Relevant<\/h3>\n\n\n\n<p>Additionally, Valkenburgh challenged another claim made by the OFAC. It alleges that <a href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/tornado-cash-founders-charged-money-laundering-and-sanctions-violations\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Storm and Semenov<span class=\"wpil-link-icon\" title=\"Link goes to external site.\" style=\"margin: 0 0 0 5px;\"><svg width=\"24\" height=\"24\" style=\"height:16px; width:16px; fill:#000000; stroke:#000000; display:inline-block;\" viewBox=\"0 0 24 24\" version=\"1.1\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" xmlns:svg=\"http:\/\/www.w3.org\/2000\/svg\"><use href=\"#wpil-svg-outbound-7-icon-path\"><\/use><\/svg><\/span><\/a> controlled the protocol\u2019s underlying smart contracts, which implies that they had some influence over the funds deposited and withdrawn by users.
