Shifke has over 30 years of experience in finance and accounting and has previously served as the CFO of several public and private companies.<\/p>\n\n\n\n<p>The amended S-3 filing also revealed that Grayscale had changed its proposed creation mechanism for its <a href=\"https:\/\/coinscreed.com\/staging\/bitcoin-mining-pools-how-to-earn-cash-from-mining-bitcoin.html\" title=\"Bitcoin Mining Pools: How to Earn Cash from Mining Bitcoin\" data-wpil-monitor-id=\"101\">Bitcoin ETF from in-kind to cash<\/a>. This means that instead of accepting<a href=\"https:\/\/coinscreed.com\/staging\/bitcoin-hash-rate-reaches-new-peak.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> Bitcoin<\/a> from authorized participants (APs) in exchange for ETF shares, Grayscale would accept cash and use it to buy Bitcoin on the open market.<\/p>\n\n\n\n<p>This change is significant because it aligns with the<a href=\"https:\/\/www.msn.com\/en-us\/money\/savingandinvesting\/sec-hints-at-a-preference-for-cash-based-bitcoin-etfs\/ar-AA1k8PJO\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> SEC\u2019s preference for cash creation, <span class=\"wpil-link-icon\" title=\"Link goes to external site.\" style=\"margin: 0 0 0 5px;\"><svg width=\"24\" height=\"24\" style=\"height:16px; width:16px; fill:#000000; stroke:#000000; display:inline-block;\" viewBox=\"0 0 24 24\" version=\"1.1\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" xmlns:svg=\"http:\/\/www.w3.org\/2000\/svg\"><use href=\"#wpil-svg-outbound-7-icon-path\"><\/use><\/svg><\/span><\/a>which the regulator believes would reduce the potential for market manipulation and fraud. The SEC has previously expressed concerns about the reliability and transparency of the Bitcoin market and has rejected several Bitcoin ETF proposals that used in-kind creations.<\/p>\n\n\n\n<p>However, not everyone agrees that cash creation is better for investors. Scott Johnsson, the general partner at VB Capital, a crypto venture capital firm, argued that cash creations could expose investors to more risks, such as slippage, tracking errors, and counterparty risks. The firm filed its application in April 2021, but the SEC rejected it in October 2021, citing the lack of a national securities exchange listing for GBTC. However, in November 2021, a U.S. appellate court ordered the SEC to review its decision, giving Grayscale another chance to pursue its ETF bid.<\/p>\n\n\n\n<p>Grayscale is not the only firm seeking the SEC\u2019s approval for a spot Bitcoin ETF. Several other asset managers, including <strong>BlackRock, Fidelity, and Franklin Templeton,<\/strong> have also filed their applications, hoping to tap into the growing demand for Bitcoin exposure among investors. However, the SEC has not approved any spot Bitcoin ETFs yet, despite approving several Bitcoin futures ETFs in October 2021.<\/p>\n\n\n\n<p>The SEC\u2019s chairman, Gary Gensler, has indicated that he is more open to<a href=\"https:\/\/academy.binance.com\/en\/articles\/bitcoin-spot-etf-vs-bitcoin-futures-etf-what-s-the-difference\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> Bitcoin futures ETFs than spot ETFs,<span class=\"wpil-link-icon\" title=\"Link goes to external site.\" style=\"margin: 0 0 0 5px;\"><svg width=\"24\" height=\"24\" style=\"height:16px; width:16px; fill:#000000; stroke:#000000; display:inline-block;\" viewBox=\"0 0 24 24\" version=\"1.1\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" xmlns:svg=\"http:\/\/www.w3.org\/2000\/svg\"><use href=\"#wpil-svg-outbound-7-icon-path\"><\/use><\/svg><\/span><\/a> as he believes the former are subject to more regulatory oversight and investor protection.
