however, they are strongly encouraged to do so.<\/p>\n\n\n\n<p>According to an email from party leaders to House members dated May 20 that was obtained by POLITICO, the Democratic Party did not urge members to vote no on the Republican-led Financial Innovation and Technology for the 21st Century (FIT21 Act) and the CBDC Anti-Surveillance State Act (H.R. 4763 and H.R. 5403, respectively).<\/p>\n\n\n\n<p>If enacted, both measures would be considered beneficial for the <a href=\"https:\/\/coinscreed.com\/staging\/biden-strikes-a-blow-to-the-cryptocurrency-industry.html\" target=\"_blank\" rel=\"noreferrer noopener\">cryptocurrency industry<\/a>.<\/p>\n\n\n\n<p>FIT21 would, among other things, strengthen the classification procedure for determining whether a cryptocurrency is a security or commodity and primarily transfer regulatory oversight of the sector to the Commodity Futures Trading Commission.<\/p>\n\n\n\n<p>The bill has received support from the U.S. crypto industry and lobbyists; in a letter dated May 16, sixty companies urged the House to adopt the bill.<\/p>\n\n\n\n<p>Conversely, the CBDC Act will impede the issuance of a Central Bank Digital Currency (CBDC) by the Federal Reserve.<\/p>\n\n\n\n<p>David Scott and Representative Maxine Waters, however, &#8220;strongly oppose&#8221; Specifically, they criticized its provision for facilitating the trading of digital commodities on the secondary market, which applies to those that were &#8220;originally presented as investment contract securities&#8221; according to the Howey test as defined by the <a href=\"https:\/\/coinscreed.com\/staging\/u-s-securities-and-exchange-commission-musk-twe.html\" target=\"_blank\" rel=\"noreferrer noopener\">Securities and Exchange Commission<\/a>.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThis language undermines decades of legal precedent and case law, thereby creating uncertainty in our traditional securities market,\u201d<\/p>\n<cite>the email said.<\/cite><\/blockquote>\n\n\n\n<p>In addition, the leaders contended that the bill &#8220;weakens investor protections and opens the door to fraud and market manipulation&#8221; by providing a &#8220;safe harbor&#8221; through which certain entities can &#8220;effectively shield&#8221; themselves from the SEC until the CFTC and SEC ratify crypto rules by filing an intent to register.<\/p>\n\n\n\n<p>The CBDC Anti-Surveillance State Act, meanwhile, would prohibit the Federal Reserve from issuing CBDCs, including for experimental programs.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.indeed.com\/career-advice\/career-development\/democratic-leadership#:~:text=A%20democratic%20leader%20is%20someone,they%20drive%20discussion%20and%20participation.\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Democratic leaders<span class=\"wpil-link-icon\" title=\"Link goes to external site.\" style=\"margin: 0 0 0 5px;\"><svg width=\"24\" height=\"24\" style=\"height:16px; width:16px; fill:#000000; stroke:#000000; display:inline-block;\" viewBox=\"0 0 24 24\" version=\"1.1\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" xmlns:svg=\"http:\/\/www.w3.org\/2000\/svg\"><use href=\"#wpil-svg-outbound-7-icon-path\"><\/use><\/svg><\/span><\/a> contend that impeding CBDCs would undermine the &#8220;preeminence of the U.S. dollar,&#8221; given that other nations attempting to circumvent sanctions are proceeding with their own CBDC initiatives.<\/p>\n\n\n\n<p><em>\u201cAccording to the Congressional Budget Office (CBO), the bill\u2019s overly broad definition of CBDC raises concerns the bill could undermine the Fed\u2019s ability to conduct monetary policy,\u201d<\/em> the email said.<em> \u201cParticularly concerning as it attempts to navigate a soft landing in regard to inflation.\u201d<\/em><\/p>\n\n\n\n<p>The floor will likely debate and approve FIT21 on Wednesday, May 22, according to Mueller of POLITICO.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>House Democrats are not required to oppose two pro-crypto bills up for a vote this week, but they are strongly urged to do so.
