but he attributed more sinister motives for the Treasury Department's involvement in the legislative process, according to CCN.<\/p>\n\n\n\n<p>In a statement acknowledging that he may have donned a &#8220;tin-foil hat,&#8221; <a href=\"https:\/\/coinscreed.com\/staging\/senate-votes-down-infrastructure-law-on-crypto-tax-regulation.html\" data-type=\"post\" data-id=\"7564\">Chervinsky <\/a>argued that the Treasury Department was looking for an alternative method of enforcing the strict reporting requirements that former Treasury Secretary Steve Mnuchin had sought to impose on self-held cryptocurrency wallets.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cThis is all about DeFi [&#8230;] This is the Treasury Department trying to work out how to get jurisdiction over DeFi [&#8230;] and also expand its warrantless surveillance over a peer-to-peer financial system.\u201d<\/p><\/blockquote>\n\n\n\n<p>Cherversinky added that he was informed that the Treasury Department first resisted exempting network validators and software developers from the bill's rigorous third-party reporting requirements because it was concerned that the amended law would not &#8220;adequately capture DeFi.&#8221;<\/p>\n\n\n\n<p>\u201cThat\u2019s why we couldn\u2019t get the language changed to only capture the centralized exchanges,\u201d he concluded:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cWe found out very quickly that it wasn\u2019t just a senator\u2019s misunderstanding [&#8230;] The Treasury Department had played an important role in drafting the language and also [ensuring] that any revision we proposed was going back to the Treasury Department for their approval or rejection.\u201d<\/p><\/blockquote>\n\n\n\n<p>According to Chervinsky, Treasury was concerned that the industry would argue that DEX liquidity providers and other <a href=\"https:\/\/coinscreed.com\/staging\/sushiswap-narrowly-escapes-becoming-the-latest-defi-hack-victim.html\" data-type=\"post\" data-id=\"8176\">DeFi <\/a>participants are participating in transaction validation and hence should be excluded from the legislation.<\/p>\n\n\n\n<p>\u201cAs I understand it, that\u2019s why we then got a competing amendment that specifically said the exemption is only for Proof-of-Work miners,\u201dChervinsky added.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cThe idea that you would carve out an exemption for what is viewed as the really bad, horrible climate change-causing, ocean-boiling Proof-of-Work mining, but then not have that exemption for Proof-of-Stake validators just made absolutely no sense.\u201d<\/p><\/blockquote>\n\n\n\n<p>Despite the <a href=\"https:\/\/coinscreed.com\/staging\/bidens-treasury-dept-nominee-to-make-crypto-regulation-top-priority.html\" data-type=\"post\" data-id=\"4327\">Treasury Department<\/a>&#8216;s retreat from its position after finding it couldn't &#8220;steamroll the industry,&#8221; Chervinsky expressed concern that unelected Treasury officials wield too much power in the legislative process.<\/p>\n\n\n\n<p>\u201cThe idea that secretly, behind the scenes, it isn\u2019t senators we\u2019re negotiating with [\u2026] it\u2019s some unknown bureaucrat buried in the <a href=\"https:\/\/coinscreed.com\/staging\/treasury-secretary-yellen-against-amending-crypto-language-in-infrastructure-bill.html\" data-type=\"post\" data-id=\"7297\">Treasury <\/a>Department \u2014 to me, that\u2019s a deeply troubling situation to be in, \u201dhe remarked.<\/p>\n\n\n\n<p>Chervinsky, on the other hand, lauded the <a href=\"https:\/\/coinscreed.com\/staging\/report-shows-that-fidelitys-crypto-ambitions-are-bigger-than-expected.html\" data-type=\"post\" data-id=\"8162\">crypto <\/a>lobby's success in opposing the provisions:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cThe entire industry basically without exception banded together to fight this [&#8230;] Yes, this bill is a threat, but more important [&#8230;] was how effectively the industry was able to rally and defend itself in D.C.\u201d&nbsp;<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Mr. Jake Chervinsky, general counsel at Compound Labs, has expressed concern that the Treasury Department is attempting to &#8220;capture&#8221;
